Description
FIDIC has, for over 50 years, issued a number of standard documents for use on construction projects. The contracts which are currently in most common use around the world are: FIDIC Short Form of Contract; FIDIC Conditions of Contract for Construction; FIDIC Conditions of Contract for Plant and Design-BuildFIDIC Conditions of Contract for EPC/Turnkey Projects.  
 
FIDIC conditions of contract are being increasingly used by the international construction industry throughout the world. In Europe, the European Commission for many projects throughout central and Eastern Europe use them. The Multilateral Development Banks (MDB), including the World Bank, the Interamerican Development Bank, the Asian Development Bank and the African Development, have adopted the FIDIC MDB Harmonised Edition of the Construction Contract.
 
Like other FIDIC contracts training courses, Intensive DAB Training Courses cover the content and scope of Module 3 of the FIDIC Contracts Manual, only that instead of focussing on the principles and basic framework of DABs in a structured programme that includes cases and worked examples, the intensive courses focus on the experience gained from DAB processes. The courses are thus tailored to  participants that already have a good understanding of DAB processes and procedures, who will be exposed to in-depth practical knowledge and problem solving scenarios from the current leaders in the DAB field. They are extended by having a DAB decision for review and comment by the trainers after the training course ends.
 
Participation is limited to only 30, with the trainers providing detailed explanation, courses, notes and case studies and leading in-depth discussions, almost at an individual level. Additionally, participants are given the opportunity to prepare a DAB decision for review and comment by the trainers after the training course ends.
 
Intensive DAB Training Courses aim to explain the use of DABs in the FIDIC Conditions of Contract for Construction and the FIDIC Conditions of Contract for Plant and Design-Build. Familiarity with the ICC and DBF Dispute Board rules and procedures is also required. The FIDIC Short Form of Contract and the FIDIC Conditions of Contract for EPC/Turnkey Contracts are also covered in detail, using the Construction and Plant Contracts as the basis. Also covered is the new FIDIC Design, Build and Operate Contract.
 
Course trainers: The trainers for these intensive training courses are consulting engineers, construction lawyers, and other construction professionals with extensive international experience. They are provided by specialist training suppliers that work closely with FIDIC, the International Chamber of Commerce, the Dispute Board Federation and the World Bank/IFC, notably DBTraining which specialises in dispute adjudication board training and dispute resolution management to the international construction and infrastructure industries. 
 
Course documentation: Participants will be provided the following materials, in English: FIDIC Construction Contract; FIDIC Plant and Design-Build Contract; course overheads; work exercises; notes on the Multilateral Development Bank Harmonised Edition of the FIDIC Construction Contract. For these extended courses, materials for preparing a DAB decision for review and comment by the trainers after the training course ends are also provided. Additionally, each participant will be entitled to a 25% discount on the purchase of the leading text in the field, namely Chern on Dispute Boards published by Wiley-Blackwell, London, 2008.
 
Course venue: Intensive DAB Training Courses take place in centrally located, five-star hotels that have extensive, high-quality accommodation and facilities.
 
Who should attend? 
Intensive DAB Training Courses are designed to help already knowledgeable participants gain the necessary confidence in working on Dispute Adjudication Boards in real-world settings, and are applicable whether the participant’s background is in representing employers, consultants or contractors. 
 
Intensive DAB Training Courses provide the necessary knowledge for professionals from government ministries and agencies, and for procurement officers, private sector employers, consulting engineers, contractors, quantity surveyors, architects, legal advisers and all involved with the implementation and management of works contracts. Intensive DAB Training Courses are particularly important for those involved in managing infrastructure projects financed under funds provided by MDBs, bilateral development agencies and the European Union.
 
Each participant who successfully completes a FIDIC-DBF  Intensive DAB Training Course is eligible for 16 credit hours by The Dispute Board Federation for its Professional Dispute Board Member Designation.
 
To obtain the greatest benefit from this workshop, it is important that participants have a good understanding of the FIDIC forms of contract and the provisions dealing with Dispute Adjudication Boards. Additionally, they  should have:
  • An in-depth knowledge of adjudication and the construction process.
  • A grasp of the general concept of claims in a construction setting.
  • A general understanding of practice and procedures relating to the adjudication process and Dispute Adjudication Boards, and an appreciation of the different possible approaches dependent on the nature of the dispute.
  • An awareness of the way arbitration and mediation differ from both adjudication and Dispute Adjudication Boards in respect of jurisdiction and natural justice.
  • Acquaintance with the ICC Dispute Board procedures.

Worked example: DAB Decision

At the end of the second day, a scenario will be provided for the preparation of a written Decision within 45 days. You are required to return the completed Decision to Ms A. Poncelet, The Dispute Board Federation, 14, rue du Rhone, 1204 Geneva, Switzerland. Your Decision will be independently assessed and individual responses given.
 
The purpose of the assessment is to help delegates identify strengths and weaknesses in their decision writing, as well as going some way towards testing knowledge of procedure, rules, etc.  Delegates showing the relevant level of competence will receive a certificate of completion for the course.
 
  Attendance fee: Euro 2100 (includes refreshments, lunches, tuition, and documentation and review of a DAB decision). Discount of Euro 200 for each participant if there is more than one participant coming from the same organization.
