These two-day seminars have been designed to offer an in-depht knowledge of the use of the FIDIC contracts currently in use. These events are based on workshop sessions.

I. Principal Course:
The fundamentals of work using the Red and Yellow Books. (Module 1)

This two-day seminar presents the essential content of the Red and Yellow Books, the manner in which they should be understood in a national context (by reference to the applicable law), as well as in the context of private international law. It thus covers the fields of contracts for construction and plant and design-build. The seminar introduces specialised notions encountered within the FIDIC contracts and explains their fundamental concepts and mechanisms. The main clauses will be commented within their context and illustrated by means of practical examples. Special emphasis will be given to topics such as measurement and valuation in the measurement contract, the lump-sum system and the engineer's role. This seminar may be combined in a cumulative or alternative manner with Principal course II.

Seminar Plan:
  • Explanations relating to the FIDIC federation
  • Preliminary thoughts in international ventures
  • Introduction to the Red Book and to the Yellow Book
  • Essential content of the Red Book and the Yellow Book
  • Managing claims, disputes, and arbitration

I. In-depth Course:
Claims and disputes. (Module 2)

This two-day seminar will enhance your knowledge as to the various claims in relation to time extensions, repayment of supplementary costs and profit, as well as rights flowing from the contract. This seminar examines the requirements for a claim, the procedure to follow in order to assert a claim as well as the principles behind the dispute resolution procedure. The course content is structured taking account of typical circumstances which may be encountered in practice. After an introduction on claims, the handling of unforeseeable events shall be studied. This will be followed by an explanation on practical questions which may arise on the workings and activities of the DAB in a number of typical situations.
