13 August 1999 FIDIC announced on 13 August 1999 to the Mediators, Adjudicators and Experts listed on its List of Experts that it is planning to launch a Dispute Adjudication Board (DAB) Assessment Programme. The letter sent to the Experts is given below. The List of Experts is available in the FIDIC Federation Directory. This letter was followed by a letter to FIDIC Member Associations announcing the new FIDIC President's List of Approved Dispute Adjudicators, together with details of application procedures. As most of you know, FIDIC's new suite of Conditions of Contract (The Construction Contract, The Plant and Design-Build Contract, The EPC Contract, and The Short Form) are about to be published in First Editions (can be ordered online at the FIDIC Bookshop). These "new Books" all call for the use of Dispute Adjudication Boards (DABs) to help resolve contract disputes, so it is anticipated that there will be an increased call for the use of DAB members in the near future. Most of you on the FIDIC LIST OF EXPERTS (Mediators, Adjudicators, Experts) have already expressed an interest in being appointed to DABs, while some only wish to seek Mediator assignments. The FIDIC Executive Committee (EC) has decided that FIDIC must take concrete steps to assure the quality of this list, so that when FIDIC is asked to propose names for DABs, it can feel confident that those names put forward will be of persons either experienced in past DABs, or with approved DAB training, plus contract administration experience. Users of the list will probably assume that FIDIC would only name those people whom it considers suitable. FIDIC has decided to commence a series of DAB Training Workshops, to start in early 2000 in London, UK. Attendance at these workshops will be limited (maximum 30, perhaps less) in order to maximise interchange between instructors and participants. To start the programme, preference will be given to persons already on the FIDIC LIST OF EXPERTS who wish to benefit from this DAB training. It is anticipated that in future issues of the list, Experts will be designated as either having had DAB experience, (for which FIDIC will expect to receive written confirmation with details), or to have successfully completed a FIDIC Training Workshop course (including assessment). Faculty for the initial DAB Workshop will be people who have served as members of Dispute Adjudication (or Review) Boards, including the principal drafter of FIDIC's new suite of major contracts. The Workshops will take place over two days, allowing ample time for participation in mock dispute cases. Comparisons will be made between FIDIC's DABs and the concept of Dispute Review Boards, for which training will also be appropriate. Costs for the Workshops are yet to be established, but FIDIC intends to offer to current Experts the Workshops at the lowest possible cost, covering only FIDIC's marginal costs for a room and meals, trainers' fees and expenses. Costs will be established soon, and would of course be made known to you before you were asked to commit to attend. In order to help FIDIC plan for the start-up of this DAB training, would you please respond to this letter, letting us know if you wish to attend the early-2000 Workshop or a later Workshop (perhaps at a venue close to you), or by informing us that you wish to apply for this requirement to be waived by reason of your experience serving on dispute boards.
